New York State enacted legislation to protect consumers from dishonest contractors who charge inflated mold assessment and remediation costs. This law, enacted on January 1, 2016, is based on NYS Dept. of Labor Law Article 32 and mandates that all individuals, contractors, and businesses involved in mold assessment and remediation must ensure that their employees are trained and certified by New York State.
According to the law, mold remediation work can only be conducted by certified contractors on residential or commercial properties if a licensed inspector in New York completes a mold inspection and provides a mold remediation plan and protocol for the NYS-licensed contractors to bid on the work.

a. PROVISION OF A MOLD REMEDIATION PLAN AND PROTOCOL:
Required for Remediation of Mold Following NYS Dept. of Labor Law, Article 32 established January 1, 2016.
b. For mold remediation to commence on any residential or commercial property, we are required to provide the Property Owners with documentation for a Mold Remediation Plan that stipulates the Mold Assessor’s required work specifications and protocols to complete the remediation process in accordance with the NYS Dept. of Labor laws and guidelines. All remediation work is to be completed by a NYS Licensed & Certified Mold Remediation Contractor.
- MOLD PROJECT CLEARANCE – Fees to be determined based on the mold remediation project specifications. Post-remediation inspection and testing for clearance [based on the clearance and testing requirements] – after remediation work has been completed, a visual inspection and testing of the finished work will be done by the assessor for project clearance.
- Optional Airborne Particle ID Testing – collection of air samples to identify airborne particulates such as fiberglass, synthetic fibers, soot, pollen, dust mites, and other airborne particulates types that occupants may have an allergic reaction to. A certified lab report will be issued with their determinations of airborne particles within 24-48 hours. Particle Testing excludes gases.

Samples collected will be submitted to an EPA-registered lab, which will include their scientific lab analysis of those samples submitted and will issue a certified written, and guaranteed, lab report of their determination of microbial activity. The lab report will be provided to the customer within 24-48 hours of my visit, provided there are no FedEx delays. The cost of next-day FedEx priority delivery is included.
